1. Personal data

We, the Briem Baumgartner Rechtsanwälte GmbH, collect, process and use your personal data only with your consent or on the basis of the mandate granted to us, for the purposes agreed with you or if there is another legal basis in accordance with the GDPR; this in compliance with the provisions of data protection and civil law.

We do collect personal data only if required for the performance and processing of our legal services or if you have voluntarily provided such data to us. Personal data is all data containing individual information about personal or factual circumstances, such as name, address, e-mail address, telephone number, date of birth, age, gender, or social security number. Sensitive data such as health data or data in connection with criminal proceedings may also be included.

2. Information and deletion

As a client or, more generally, as a data subject, you have the right – subject to the lawyer’s duty of confidentiality – to obtain information about your stored personal data, its origin and recipients and the purpose of the data processing, as well as the right to rectification, data transmission, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data. Insofar as there are changes to your personal data, we kindly request that you inform us accordingly.

You have the right to revoke your consent to the use of your personal data by us at any time. Your request for information, deletion, correction, objection and/or transfer of data, in the latter case, provided that this does not involve a disproportionate effort, may be addressed to the address of our law firm indicated in point 8 of this declaration.

If you are of the opinion that the processing of your personal data by us violates the applicable data protection law or that your data protection rights have been violated in any other way, you have the possibility to submit a complaint to the competent supervisory authority. In Austria, the competent authority is the Austrian Data Protection Authority (Österreichische Datenschutzkommission).

3. Data security

Your personal data is protected by appropriate organizational and technical precautions. These precautions relate to protection against unauthorized, illegal or even accidental access, processing, loss, use and manipulation of data. Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information you disclose to us via the internet may be viewed and used by other persons.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacking attacks on e-mail accounts or telephones, interceptions of faxes).

4. Use of data

We will not process the data provided to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR.

5. Transfer of data to third parties

In order to fulfill the mandate granted to us, it may also be necessary to forward your data to third parties (e.g. opposing parties, substitutes, insurance companies, service providers we use and to whom we provide data, etc.), courts or authorities. Your data will only be forwarded on the basis of the DSGVO, in particular to fulfill the mandate granted to us, or on the basis of your prior consent.

6. Disclosure of data leaks

We strive to ensure that data leaks are identified at an early stage and, if necessary, reported immediately to you or the competent supervisory authority, including the respective categories of data affected.

7. Retention of data

We will not retain data for longer than necessary to fulfill our contractual or and comply with legal obligations and for purposes of defending liability claims.
